In my opinion; not that this is a bad idea but with the US being in 16 trillion dollar debt there should be no tax cuts.This should also include no extension of Bush tad cuts beyond 2012.This insane idea that tax cut for the rich create jobs is nonsense. The tax cuts should be for small business. If ths UJS ever has a surplus then tax cuts could be considered. But both parties are playing to their base in a election year.

Dylan Ratigan: To Eric Holder – A Simple Way To Prosecute Bank Crimes

Shahien Nasiripour has a great scoop in the FT – bank regulators have uncovered up to 5000 military families who were foreclosed on "illegally" by mortgage servicers.
Foreclosures on active duty troops is usually a big no-no, for a lot of reasons – for instance, when your credit rating is damaged by a foreclosure, it can impact your national security clearance.
In addition, there’s enormous stress that the soldier goes through when his or her family is facing a threat of eviction, and it’s the kind of stress that makes him or her less equipped to be ready in a warzone.
Congressman Bob Filner has even accused banks of “homicide” against American troops, blaming the banks for suicides resulting from the increased stress brought on by aggressive debt collection techniques.
There have been laws to protect troops from unscrupulous lending practices going all the way back to the First World War. The most recent revision to these laws is the Servicemember Civil Relief Act, which was signed in 2003. Congressman Brad Miller, who helped author the most recent version of this law, explained the rationale for the law as follows:
****The Service Members Civil Relief Act is very clear: if you’re in harm’s way in our nation’s military, you can devote your whole energy to our nation’s service without worrying what’s happening in a courthouse back home. And if you have a claim against someone in our military, you can wait until they get home and can defend themselves.
Miller is a Democrat from North Carolina, but the bill was signed by George W. Bush, so there’s a bipartisan consensus on not foreclosing on troops fighting in wars.
----> Yet, as the FT story shows, it has become clear that "big banks" are routinely ignoring the law.
Miller noted,
"The SCRA is not some obscure legal technicality that might just have escaped the attention of mortgage servicers. Those servicers are all affiliates of the biggest banks, but they’re huge and specialized. Servicing mortgages is all they do, and they really don’t have that many laws to keep up with. "They have got to have known what the law required", and consciously decided that they could just ignore it, the same way they apparently decided it was okay to file false affidavits in legal proceedings.
--->In all likelihood, these banks simply never set up their management processes to handle anything but, an *aggressive foreclosure steam-roller. And so, they are breaking the law.

Banks admit this.
*JP Morgan apologized back in February in a Congressional hearing for overcharging 4000 military families and illegally foreclosing on 18 of them.
In that hearing, one foreclosure defense attorney pointed out that jail time for officials of the bank doing the foreclosing would be a deterrent to these practices, an apology would not be.

Much has been made of President Obama’s argument that the banks did nothing illegally, and various other scholars and officials have argued that prosecuting the banks is far too expensive and difficult.
****Yet, the SCRA is a simple law with teeth; it carries real jail time, and the parties have already confessed to the crime. Here’s Section 303(d)(1) of that law, which spells out penalties. (PDF)
(1) MISDEMEANOR.—A person who knowingly makes or causes to be made a sale, foreclosure, or seizure of property that is prohibited by subsection (c), or who knowingly attempts to do so, shall be fined as provided in title 18, United States Code, or imprisoned for not more than one year, or both.
Interestingly, the Department of Justice seems to agree with this interpretation. Here’s a press release from the Department of Justice on a settlement of some of these claims, from Bank of America. I’ve bolded the important part.
The Justice Department announced today that, as part of its settlement with BAC Home Loans Servicing LP, a subsidiary of Bank of America Corporation, servicemembers whose homes were unlawfully foreclosed upon will each receive a minimum $116,785 plus compensation for any equity lost to compensate them for the bank’s alleged violation of the Servicemember Civil Relief Act (SCRA).

Note the use of the word “alleged.” Bank of America isn’t admitting anything, and the Eric Holder’s Department of Justice isn’t making them admit anything. Otherwise, the penalties might come into play. Sometimes, law can get very complex. But sometimes, it isn’t. JP Morgan admitted to violating the law. There are up to 5000 more cases, and each one carries up to a year in jail.
Eric Holder and various US Attorneys around the country aren’t prosecuting bank foreclosures on active duty troops, even though they know it is happening. Bank regulators know about the problem. Congress knows about the problem. Certainly, the Pentagon knows about the problem. Where are the prosecutions? Is there an internal policy that certain crimes are not to be prosecuted? Isn’t that something the public should be aware of?

As Congressman Miller put it, “The continued failure to pursue criminal charges in the face of flagrant violations of the criminal law is destroying Americans’ faith in their government and democracy. In a democracy, no one is too big to prosecute

“In order to do business in Massachusetts, GMAC has to follow the law before foreclosing on homeowners,” Coakley said in a statement. “With today’s action, it appears GMAC has acknowledged it has a problem following those laws and being held accountable for doing so.”

Coakley’s lawsuit, filed Thursday in Suffolk Superior Court, accuses Bank of America, Wells Fargo, JP Morgan Chase, Citi and GMAC of using fraudulent documentation during foreclosure proceedings, including so-called “robo-signing,” and illegally foreclosed on properties without holding the actual mortgages.

John, I viewed the video. As usual I may look at things from a less obvious angle then most but I think its worth sharing.

For some time now I have been stating that the problem is government and while big business is not necessarily our friend, WE the people have a degree of control over a greedy business but an over reaching, over spending, corrupt or out of control government controls us.

So lets first examine this idea that a group of powerful Capitalists would somehow benefit if we were to lose all our buying power. Certainly the super rich would be better off then us but nobody benefits financially from world chaos. However, a ruling entity could gain a whole lot more power in such a world. Without individual Liberty or freedom of choice, our usefulness would consist of how much we can contribute to the collective and how much more power they could gain. So the best government is one that affords us the most freedom, along with some protection from those more powerful then us.

The Capitalists don't want to rule over us, they just want to make money. Like a gambling casino, many don't necessarily care whether you lose all yours, as long as they make money. So knowing this, we have incite on how to reasonably protect our investments. In the 90's they offered easy winnings. Put your money down on any dot com stock and you cannot lose, at least for a while, until the bubble burst. After that real estate was the bet of choice. Real estate will never go down they said. Bidding wars in sued over already inflated houses and then again the bubble burst.

Now the game is fear. Sell all that you have and place your chips on Gold, at sky high prices. After viewing that video did you consider that? Ask yourself, is Celente your friend? Glenn Beck and others who preach Gold? No my friend, stay diverse. Yes you will lose in some investments but will gain in others. If the Capitalist are really in control, then you will not lose everything because they need suckers like us. However, if a corrupt government is behind all this, then heaven help us, because we are in for a nasty ride.

Forget that the ACLU called it "an historic threat to American citizens", this bill is so dangerous not only to our rights but to our country's security that it was criticized by the Directors of the FBI, the CIA, the National Intelligence Director and the U.S. Defense Secretary! For the first time in our history, if this Act is not vetoed, American citizens may not be guaranteed their Article III right to trial.

Caspian, so do you think the Capitalists or the Lobbyists only lobby Congress? Again, their goal is to make money. So they lobby us as well. They will trick us, entice us, preach doom and gloom and promise us the world but they have no control over us unless we decide to buy into their scheme. It is the same with Congress, they have the power and the ability to ignore the lobbyists but they irresponsibly or selfishly choose not to. The lobbyists have no power to legislate, only government and only government has power over us.

As for Celente, he seems to be a Capitalist highly leveraged in Gold options and would stand to lose a lot of money if the economy were to get better because Gold would certainly drop. Given the recent news of unemployment numbers getting better preaching doom and gloom might buy him enough time to unload his Gold positions. You should know by now that is the way Capitalists think. Do you believe him? Is he a modern day Paul Revere that cares about us or is he protecting himself? When You Go Conservative Black, You Better Watch Your Back:

With the mainstream media giddily reporting on an alleged affair involving Republican presidential candidate Herman Cain, how long can it be before they break the news that their 2004 vice presidential candidate conceived a “love child” with his mistress, Rielle Hunter?

The left is trying to destroy Cain with a miasma of hazy accusations leveled by three troubled women. Considered individually, the accusations are utterly unbelievable. They are even less credible taken together. This is how liberals destroy a man, out of nothing.

After the first round of baseless accusations against Cain, an endless stream of pundits rolled out the cliche — as if it were the height of originality — “This isn’t he said-she said; it’s he-said, she-said, she-said, she-said, she–said.”

Au contraire: We had two “shes” and only one “said.”

Remember? Only two women were willing to give their names. And as soon as they did, we discovered that they were highly suspicious accusers with nothing more than their personal honor to support the allegations. Only one of the two would even say what Cain allegedly did.

The first one was Sharon Bialek, who claimed that Cain grabbed her crotch in a car.

Then we found out Bialek was in constant financial trouble, had been involved in a paternity lawsuit, was known as a “gold digger,” had a string of debts and had twice filed for personal bankruptcy. Also, she admitted she knew Obama’s dirty tricks specialist, David Axelrod, from living in the same building with him.

Her personal history is relevant because she produced no evidence. We had to take her word. (Which was not helped by seeing her standing with Gloria Allred.)

The second one, Karen Kraushaar, made unspecified allegations of a “hostile environment” when she was working for Cain, but refuses to say what those allegations were. This despite the fact that the National Restaurant Association waived her confidentiality agreement, thus allowing her to go public.

That’s one “she,” but no “said.”

Cain said he had once told Kraushaar she was as tall as his wife — which would be one of the more worthy sexual harassment claims settled by an American company in recent years.

Why won’t she say? We’re not talking about rape. Kraushaar can’t say, “I don’t want to relive being told I was the same height as his wife!” With all the nonsense that passes for a “hostile environment,” either Kraushaar tells us what Cain allegedly did, or her blind accusation is worth less than nothing.

As if that weren’t enough, then it turned out that Kraushaar had also filed a complaint at her next job just three years later, charging that a manager had circulated a sexually explicit joke email comparing computers to men and women. She demanded a raise and the right to work at home.

Maybe Kraushaar is the most unlucky woman in the world. But the simpler explanation is that she is not a credible witness on the workplace atmosphere.

And now we have Ginger White stepping forward to claim that she had a 13-year affair with Cain. Cain admits he was friends with White, but he categorically, adamantly denies having an affair with her.

White has the whole combo-platter of questionable accuser attributes: She’s another financially troubled, twice-divorced, unemployed single mother, who has claimed sexual harassment in the past, declared bankruptcy once, was accused of stalking and had a libel judgment entered against her just this year. So far in 2011, she’s had nine liens put on her property.

But we’re supposed to ignore all of that because she’s the third woman of questionable character to make an implausible allegation. Liberals say there’s a pattern, but the only pattern is of their making far-fetched accusations of a sexual nature against Cain.

White’s proof that she had a 13-year affair is that she has two of Cain’s books signed by him — one with the incriminating inscription, “Friends are forever! Everything else is a bonus,” and the other, “Miss G, you have already made a ‘big difference!’ Stay focused as you pursue your next destination.” (I know — filthy!)

If that’s proof of an affair, I’ve had thousands of them without even realizing it.

Also, White produced evidence that Cain had texted or called her cell phone 61 times during four non-consecutive months — but did not reveal what those texts said. (“Would you please return my lawn mower?”)

Again, if that’s proof of an affair, I’m having hundreds of them at this very moment.

This is the sort of evidence you get with an actual sexual predator: Bill Clinton’s accusers had gifts, taped phone conversations with him and a semen-stained dress.

Gennifer Flowers produced taped telephone calls with Clinton totaling thousands of words between them, with him counseling her on how to deny their affair: “If they ever hit you with it, just say no, and go on. There’s nothing they can do … But when they — if somebody contacts you, I need to know … All you got to do is deny it.”

Paula Jones had multiple same-day witnesses — including the state troopers who worked for Clinton and had already told the press about a “Paula” they brought to Clinton’s hotel room. And that was for a single incident.

Monica Lewinsky had lots of gifts from Clinton, including a hat pin, two brooches, a marble bear figurine, a T-shirt from Martha’s Vineyard and Walt Whitman’s “Leaves of Grass,” all of which she mysteriously placed with Clinton’s secretary, Betty Currie, during the investigation, as well as a semen-stained dress, which Monica kept.

Ginger White claims she had a 13-year affair with Cain — and all she has are two books with inscriptions that could have been written to an auto mechanic who waited in line at a Cain book signing. Even her business partner during the alleged affair says White never mentioned Cain’s name.

These women are like triple-A ball players with the stats being: number of bankruptcies, smallest bank account, number of liens, most false claims, number of children out of wedlock, degrees of separation from David Axelrod, total trips to human resources and so on.

That wouldn’t be dispositive — except for the fact that their only evidence is their word.

But this is how liberals dirty you up when they’ve got nothing: They launch a series of false accusations, knowing that Americans with busy lives won’t follow each story to the end and notice that they were all blind alleys.

The liberal media is an old story, but it’s still a big story when it comes to creating the impression of scandal out of thin air.

Most people say, “Where there’s smoke, there’s fire.” I say, “Where there’s smoke around a conservative, there are journalists furiously rubbing two sticks together.”

Caspian, I am not saying they are doing a good job of representing us and that is what the problem is. What I am saying is, it is ALL in CONGRESS / GOVERNMENTS CONTROL to pass proper legislation. Otherwise, we the people, should forget about government all together and just contact a lobbyist and ask them to pass legislation.

There are 3 scenarios:

A) Government is walking down the street and gets mugged by a lobbyist, unable to defend itself, it hands over the peoples money.

B) Government mistakenly is persuaded by lobbyists to do things that benefit the wealthy few and think that somehow will help us but turns out to not be an overall benefit to our society.

C) Government corruptly and for selfish reasons are enticed to listen to lobbyists over the people, knowing full well it will likely hurt the people.

If you believe A is true, then you might also be interested in buying a tunnel I will sell you, so you never have to pay another toll. If you believe B and/or C are true, then you can only honestly conclude the problem is government.

Senate Passes Bill Allowing Indefinite Detention of Americans ... Considers Bill Authorizing More Torture

The Senate passed a bill today allowing indefinite detention of American citizens living within the U.S.

While some have claimed that this is incorrect, and that American citizens would be exempted from the indefinite detention within U.S. borders authorized by the Act, the Committee chairman who co-sponsored the bill – Carl Levin – stated today in Senate debate that it could apply to American citizens.

Levin cited the Supreme Court case of Hamdi which ruled that American citizens can be treated as enemy combatants:

“The Supreme Court has recently ruled there is no bar to the United States holding one of its own citizens as an enemy combatant,” said Levin. “This is the Supreme Court speaking.“

Under questioning from Rand Paul, co-sponsor John McCain said that Americans suspected of terrorism could be sent to Guantanamo.

The provision would authorize the military to indefinitely detain individuals — including U.S. citizens — without charge or trial.



“If these provisions pass, we could see American citizens being sent to Guantanamo Bay,” Rand said in the video. “This should be alarming to everyone watching this proceeding today. Because it puts every single American citizen at risk.”



“There is one thing and one thing only protecting innocent Americans from being detained at will at the hands of a too-powerful state — our Constitution, and the checks we put on government power,” he continued. “Should we err today and remove some of the most important checks on state power in the name of fighting terrorism, well, then the terrorists have won.”

John, I submit to you the beast is not a one-headed beast but two. The Big Corporate greedy "head" that can only harm us by using this "tool" called big government and the "head" of big government itself. Show me where in the bible does Jesus command that the rich should feed the beast of big government in order to help the poor? He gives each of us the freedom to decide for ourselves. Seeds will grow without this currency, without the rules regulating its use. Seeds will grow without the permission of corrupted legislators. Seeds will grow locally, without the need for a transnational corporation to profit. Heirloom seeds do beautifully; patented seeds, pushed by corrupted legislators, are pure theft and an insult. Food is as basic a human right as there is. Being provided with a stake at the gambling table (“being provided with opportunity”) is not. Evolve away from greed, from this ethic of pay-up-or-die, and toward an ethic of let’s do what we need to so that no one is starving while the rest of us are eating, and forget about this silly currency racket,-and we’ll be so much better off in the ways that matter.

Evolve away from the notion of grow-or-die,-keep on increasing economic activity, increasing profits, for ever and ever, no matter the cost to the planet and its people, this notion that enables the elites to forever defer social justice by claiming (wink, wink) that “if we keep growing the pie, eventually there will be enough for everyone” –and evolve toward a new kind of economy that makes the old economy superfluous- and we’ll be so much better off. The societal ethos for this new economy has always been in us; it keeps rearing its beautiful, noble and loving head whenever there is need and the idiocy of the currency notion is forgotten. We have the heart for it; now we just have to cultivate the mind for it.

MQ, I except climate change but not so much that man has caused it or that man can do much to correct it. Yes, the nature of the profiteer is to deny anything that might cost him profits. But the nature of the big government Left is to never pass up a chance for more government intervention, regulations or control in the lives of free minded responsible individuals who are not in it for profit.

You claim, “starvation occurs in famine-stricken areas because profiteers intercept charitable aid.” I haven’t heard that one. I have heard where corrupt foreign governments steal the aid meant for the starving in really poor countries.

So I have a question that will examine your intentions. If man could successfully plant those seeds and feed the multitudes privately on their own, without having to go through government at all, would you accept that? Let the outcome and results decide what is right. Not the big government ideology of the Left or profits of the Right.

North Korea making missile able to hit U.S.:

Republicans press Pentagon for long-range interceptors

December 5, 2011

New intelligence indicates that North Korea is moving ahead with building its first road-mobile intercontinental ballistic missile, an easily hidden weapon capable of hitting the United States, according to Obama administration officials.

The intelligence was revealed in a classified Capitol Hill briefing last month. Its existence was made public in a letter to Defense Secretary Leon E. Panetta from five House Republicans.

"As members of the House Armed Services subcommittee on strategic forces ..., we write out of concerns about new intelligence concerning foreign developments in long-range ballistic missile development, specifically ballistic missiles capable of attacking the United States," the Nov. 17 letter said.

"We believe this new intelligence reiterates the need for the administration to correct its priorities regarding missile defenses, which should have, first and foremost, the missile defense of the homeland."

Officials familiar with the intelligence said government analysts believe the missile could be a variant of North Korea's new Musudan intermediate-range missile, first disclosed publicly in October 2010.

Other intelligence indicates that the new ICBM may be under development at a huge missile testing facility on North Korea's western coast.

Prior to its mobile ICBM, North Korea's long-range missiles were the pad-launched Taepodong-1 prototype, and the Taepodong-2 (TD-2) dual-use ICBM and space launcher. The TD-2 was test-launched in April 2009.

'Direct threat'

Mobile missiles are difficult for tracking radar to locate, making them easier to hide. They also can be set up and launched much more quickly than missiles fired from silos or launchpads.

China's military recently deployed two new mobile ICBMs, the DF-31 and DF-31A. It is not known whether North Korea's new mobile missile is based on Chinese technology. China in the past has provided missile technology to North Korea, a fraternal communist ally.

The first indications of Pyongyang's new mobile ICBM were made public in June by Robert M. Gates, who was defense secretary at the time.

After a speech in Singapore, Mr. Gates said, "With the continued development of long-range missiles and potentially a road-mobile intercontinental ballistic missile and their continuing development of nuclear weapons, ... North Korea is in the process of becoming a direct threat to the United States."

The new intelligence was discussed during a closed-door briefing in mid-November for the House Armed Services subcommittee on strategic forces and discussed in the letter to Mr. Panetta. The letter did not say specifically that the missile was North Korean, but it quoted Mr. Gates on Pyongyang's mobile ICBM development.

The letter was signed by Rep. Michael R. Turner, Ohio Republican and chairman of the subcommittee; Rep. Mike Rogers, Michigan Republican and chairman of the House Permanent Select Committee on Intelligence; and Republican Reps. Trent Franks of Arizona, Doug Lamborn of Colorado and Mac Thornberry of Texas.

Congressional aides declined to comment on the intelligence.

Administration officials familiar with the missile data said U.S. intelligence analysts have some disagreement over the developments.

Implications for talks

The intelligence on North Korea's progress on a mobile ICBM was disclosed as the Obama administration is seeking to restart the failed six-nation talks on North Korea's nuclear program.

Glyn Davies, special envoy for North Korea, leaves Tuesday for talks in China, Japan and South Korea about North Korea's nuclear program, the State Department announced Monday.

Last week, North Korea issued a government white paper that defended its April 2009 launch of a Taepodong-2 as part of a satellite development program.

Government analysts viewed the statement as an indication that North Korea may be preparing for a missile flight test.

The United Nations imposed unprecedented sanctions on North Korea after a 2009 test of a nuclear device.

Three paths

Details of North Korea's first mobile intermediate-range missile, the Musudan, and the new west coast North Korean launch facility were made public in classified State Department cables on the anti-secrecy website WikiLeaks.

A February 2010 cable outlining a U.S.-Russian exchange on missile threats stated that the U.S. government suspects North Korea has three paths to building ICBMs.

One is using the Taepodong-2, with a range of up to 9,300 miles, as its main strategic missile. A second way is to further develop the ranges of existing missiles like the Musudan, and last is to "use the very large launch facility that is being constructed on the west coast of North Korea to launch a very large missile," the cable said.

The cable said the size of the facility is a concern because "it does not simply replicate other sites."

"This facility is much larger than the Taepodong launch facility," the cable said. "This is not to say there is evidence of a new missile system larger than the Taepodong-2 being developed, but it suggests the possibility."

An Oct. 6, 2009, cable on North Korea's missile program said the Musudan intermediate-range missile is based on Russia's SS-N-6 submarine-launched missile that has a range of up to 2,400 miles.

The Musudan uses an advanced liquid propellent called unsymmetrical dimethylhydrazine (UDMH) and nitrogen tetroxide (N204) that are easier to store in missiles.

"Development of the Musudan with this more advanced propulsion technology allows North Korea to build even longer-range missiles - or shorter range missiles with greater payload capacity - than would be possible using Scud-type technology," the cable said.

North Korea also has a new solid-fueled short-range missile called the Toksa, with a range of 75 miles, and has sold a number of shorter-range Musudan missiles to Iran, the report said.

'Hedging strategy'

In their letter, the five lawmakers called on the Pentagon to reverse its decision to curb development of long-range ground-based interceptors in favor of European-based missile defenses against Iranian missiles. They also asked for the Pentagon's plan for a "hedging strategy" to be prepared to counter new missile threats like the North Korean mobile ICBM.

"In view of the briefing the subcommittee received this week, we do not believe the United States can afford further delay in the release of the hedging strategy by the Department of Defense," they stated, asking for a report on the strategy by the end of the year.

Asked about the new intelligence, Cmdr. Leslie Hull-Ryde said the Pentagon had nothing to add to Mr. Gates' comments.

"Specific information related to North Korea's development of road-mobile ICBM would be an intelligence matter, and it is our policy not to comment on intelligence matters," she said.

A U.S. intelligence community spokesman referred a reporter's questions about the new intelligence to the February statement to Congress by James Clapper, director of national intelligence.

Mr. Clapper stated in his prepared remarks that "North Korea's progress in developing the TD-2 shows its determination to achieve long-range ballistic missile and space-launch capabilities. If configured as an ICBM, the TD-2 could reach at least portions of the United States; the TD-2 or associated technologies also could be exported."

Gates' prediction

Mr. Gates first told reporters Jan. 11 during a visit to China that North Korea's progress in building intercontinental ballistic missiles was turning the Pyongyang regime into a "direct threat to the United States."

Pressed for details, he said, "I don't think it's an immediate threat, no. But on the other hand, I don't think it's a five-year threat."

"Let me be precise," he added. "I think that North Korea will have developed an intercontinental ballistic missile within that time frame, not that they will have huge numbers or anything like that, but I believe they will have a very limited capability."

The Daily Beast quoted Mr. Gates in June saying, "They are developing a road-mobile ICBM. I never would have dreamed they would go to a road-mobile before testing a static ICBM. It's a huge problem. As we've found out in a lot of places, finding mobile missiles is very tough."

Richard Fisher, a military analyst with the International Assessment and Strategy Center, said, "A nuclear armed North Korean road mobile ICBM would pose a spectacular challenge to the U.S.-led alliance system in Northeast Asia, as Pyongyang could severely undermine U.S. extended nuclear deterrence commitments."
